S2P PRIVACY POLICY
1. INTRODUCTION
1.1 This privacy policy (the Privacy Policy) applies to all persons using the School 2 Parent mobile application and website that is owned by, provided by or connected with School 2 Parent Proprietary Limited (Registration No. 2019/034234/07) (“S2P”) that may either be (i) installed or downloaded from an online application store and accessed via a mobile device (“Mobile Application”) or (ii) accessed at the internet website with the address www.school2parent.co.za (“Web Application”) and includes any content or services which are included in or accessible from the Mobile Application or Web Application. (collectively referred to as the “Service”).
1.2 The Service provides a one-way communication system which allows schools to communicate messages, information and/or updates about a child’s performance, well-being and behaviour to the respective child’s parents and/or legal guardians (covering scholastic, emotional, social, physical and ethical categories). By registering an account and/or subscribing to the Service, the person that does so (the User) accepts and agrees to this Privacy Policy and expressly consents to the use and disclosure of their and/or their child’s personal information in accordance with the provisions of this Privacy Policy. If the User does not agree to the provisions of this Privacy Policy, the User may not access or use the Service.
1.3 S2P reserves the right to amend this Privacy Policy or add provisions to it at any time. By continuing to use and access this Service, the User agrees to the amended versions as may be made available by S2P from time to time.
2. INFORMATION COLLECTED
2.1 If the User registers an account and/or subscribes to the Service, S2P will collect and use the User’s personal information. This information may include any information relating to the User including, without limitation, the User’s name and contact details, information relating to the gender, sex, marital status or age of the User, the User’s financial information and transaction history, details of the User’s visits to the Service and any other online identifiers or other particular assignment to the User.
2.2 If a User accesses the Service without giving S2P any personal information, S2P may still gather certain non-personal information, including information regarding the User’s activities on the mobile and web application in relation to the Service.
3. PROCESSING INFORMATION OF CHILDREN
3.1 The processing of children’s personal information (including without limitation information relating to a child’s performance, well-being and behaviour) forms an integral part of the Service. A child’s personal information may be obtained by S2P from the child’s school, its teaching staff and/or the User. The User intends using the Service in order to receive messages and communications from the User’s child’s school and/or S2P. Accordingly, the User represents and warrants that the User is the relevant child’s lawful parent/guardian and that the User is legally entitled to receive information and communications regarding the child. Further, the User hereby consents to S2P processing the child’s information for purposes relating to the Service.
3.2 In providing the Service, S2P will only share or make available children’s personal information to authorised parties, namely the school and its authorised Users. In this regard, Users may only receive communications regarding their respective child’s personal information.
3.3 In any instance that S2P collects children’s information, S2P will retain that information only so long as reasonably necessary.
4. PURPOSE FOR WHICH INFORMATION IS USED
The purposes for which S2P uses personal information (including children’s personal information) includes, but is not limited to:
4.1 providing individual communications (such as reports, messages and updates) to a child’s lawful parent or guardian in respect of the child’s performance, well-being and behaviour;
4.2 providing general communications (such as blog articles, content or other material) in relation to general parental guidance and information;
4.3 facilitating the User’s transactions when using the Service;
4.4 improving and optimising the User’s experience when using the Service;
4.5 marketing, promoting and advertising services to the User;
4.6 detection and prevention of fraud, identity theft or abuse of the Service; and
4.7 communicating with the User for S2P’s internal purposes.
5. RELEASE OF INFORMATION
S2P may release or share the User’s personal information or disclose it to third parties in certain circumstances, including, but not limited to the following:
5.1 in order for S2P to provide the Service;
5.2 in order for S2P’s service providers to operate and host the Service;
5.3 if S2P is required or allowed to do so by law or a court order;
5.4 in order for S2P to enforce its rights.
6. SECURITY
6.1 For purposes relating to the Service, S2P uses systems that are sufficiently secure with reference to accepted technological standards at the time of transactions.
6.2 S2P will secure the integrity and confidentiality of Users’ personal information and children’s information in its possession and under its control by taking appropriate, reasonable technical and organisational measures to prevent: (i) loss of, damage to or unauthorised destruction of personal information; and (ii) unlawful access to or processing of personal information.
6.3 Furthermore, any personal information (including children’s personal information) that S2P provides to third party service providers, as set out in clause 5, will be subject to an appropriate data transfer agreement ensuring that such further processing is only used for the purposes for which the information was transferred.
7. MARKETING AND PROMOTIONAL MATERIAL
7.1 S2P may from time to time send marketing and promotional material to the User. By subscribing to the Service, the User consents to S2P sending such material to the User.
7.2 The User may unsubscribe from receiving further marketing and promotional material. If the User wishes to do so, the User can follow the “unsubscribe” link in the material or send an email to S2P.
8. TRANSFER OF PERSONAL INFORMATION
8.1 Personal information collected by S2P may be transferred to persons in other countries. The User consents to such transfer. S2P will take reasonable steps to ensure that such persons have appropriate privacy measures in place.
8.2 S2P is aware that it may have to obtain the necessary regulator’s authorisation if it wants to transfer personal information including children’s information to a third party in a foreign country that does not provide an adequate level of protection for the processing of personal information.
9. COOKIES
9.1 The Service makes use of cookies. Cookies store information regarding Users. Cookies have various purposes, such as improving the User’s experience on the Service and to facilitate the User’s use of the Service.
9.2 Users may disable or decline cookies. However, if the User does so, the User might not be able to use the Service properly and certain aspects of the Service might not function.
